Being named a Personal Representative or Trustee often comes at a difficult time. Many individuals step into the role unexpectedly while also being asked to make important real estate and financial decisions during estate or trust administration.
My name is Kirk Shaw, and I bring more than 30 years of experience in real estate and mortgage lending to estate and probate-related property matters in Maricopa County. I am a Licensed Realtor with DeLex Realty and a Licensed Loan Consultant with Counsel Mortgage Group, LLC, allowing me to support fiduciaries with both probate real estate and estate-related financing considerations when appropriate.
Throughout my career, I’ve represented buyers and sellers across a wide range of market conditions, managed residential and investment property transactions, and helped families determine how and when to sell real estate. In estate and trust situations, these decisions often involve added responsibility, documentation, and oversight. Pricing, timing, and property preparation can directly affect outcomes for beneficiaries, and I approach each situation with that responsibility in mind.
My background in mortgage lending complements my real estate experience by allowing me to evaluate financing issues that may arise during probate or trust administration, such as refinancing estate property, addressing existing liens, or understanding how current financing impacts a potential sale. When lending is part of the conversation, all activity is coordinated with the fiduciary and legal counsel and, when required, subject to court approval.
What matters most to me is how people feel during this process. Many of the individuals I work with did not seek out this responsibility; they accepted it out of duty to a loved one. I believe Personal Representatives and Trustees deserve clear explanations, realistic expectations, and support that respects both the legal and emotional responsibilities they carry.
When real property is involved, I work collaboratively with estate and probate attorneys, financial advisors, and other professionals to ensure communication is clear, documentation is organized, and next steps are thoughtful—not rushed. Sometimes that means preparing a property for sale. Other times, it means helping a fiduciary understand property valuation, market conditions, or available options before any decisions are made.
